“The Ombudsman reproaches the mayor for not adopting any measure to alleviate the lack of personnel and means of the Benidorm Urban Planning department.” This was revealed this Thursday by the municipal group Ciudadanos (Cs) in the Benidorm City Council who has urged the Mayor to request urgent assistance from the Provincial Council and Consellería and urgently initiate the hiring of technical and human resources necessary to deal with urban infractions in the tourist capital.
The spokesman for Citizens, Juan Balastegui, has reported the latest letter from the Ombudsman of Spain received at the town hall. “In it, he relates that a municipal architect acknowledges that there is no instructor for urban discipline or execution orders, or no legal technician to report on responsible statements of work, or sufficient administrative staff to file complaints, manage allegations of infractions or penalties, nor is it possible the link between databases, etc “, indicated the mayor.
Balastegui has reported paragraphs of the document addressed to the Mayor, who is responsible for directing the local government: “the Ombudsman of Spain reproaches him that seven months after sending him writings, he limits himself to sending the architect’s report in which he communicates that It is not aware of any measures being taken in the urban discipline department ”. In addition, W warns of his concern about the precarious situation of the department because, being fully aware that Mayor’s Office, it does not react or adopt any measures ”.
Faced with this situation, the councilor of Cs has demanded that the Mayor of Benidorm request urgent assistance from the Alicante Provincial Council and the Department of Housing to deal with claims and urban complaints that are presented in the town hall and thus manage the blocked files, a possibility contemplated in the Law 5/2014, of July 25, on Spatial Planning, Urban Planning and Landscape, of the Valencian Community, and to which the Ombudsman himself alludes.
It has also demanded to urgently convene the procedure for hiring technical personnel in the area and to hire computer assistance to link databases between work files, execution orders, openings and infractions. Balastegui explained that “a year after denouncing that there were 3,000 unsolved files, complaints from neighbors, the Síndic de Greuges and even the Ombudsman for the chaotic service we provide are piling up.”
The Cs spokesman has also explained that in the commissions on Monday he also warned about the existence of new complaints processed by the Síndic de Greuges due to inactivity in the face of complaints of illegal works and lack of response to writings. Balastegui pointed out that “it is unacceptable that the mayor of Urbanism, who has been in charge of the area since 2015, answered us that they do process the files, and that the reason they go to higher authorities is that they do not like the resolutions.” “They are not responding to complaints nor is there monitoring of infractions as the technicians themselves acknowledge and even the recommendations of these entities are accepted,” he said.
Finally, the councilor regretted that “Benidorm is going to close the year saving several million euros in Personnel, due to retirements, not substitutions and the non-application of the VPT, but the PP refuses to hire personnel in collapsed areas, now that employment is so much needed ”.
