Extension of ERTE: Companies with a file must renew it before October 10

Companies that are currently in a ERTE covid They will have to renew their file with the labor authority before October 10. And, unless the competent Administration tells them otherwise, said file would have been renewed and they will continue to access quota exemptions. An important change in the negotiation, because until now the government’s position was to apply administrative silence, that is, if the labor authority did not say anything, the ERTE would be knocked down. Companies that do not renew the file will lose it. This has been the consensus reached between the Government and the social agents in the meeting this Thursday to try to agree on a new extension of the ERTE. The agreement is not yet closed and the positions between the parties, especially on the question of linking training and ERTE, are still distant. Currently 253,000 workers throughout Spain -50,000 in Catalonia- are affected by an ERTE, either partial or total.

The clock is ticking and the date of the last Council of Ministers of the month, scheduled for September 28, is approaching. Government and social agents have conspired this Thursday not to force deadlines and have the negotiation closed before that date. This Friday at 10 in the morning a meeting is scheduled, which if it does not end with an agreement would give way to a weekend of intense contacts at the highest level between the bosses, trade union leaders and the ministries of Labor and Social Security. And with Moncloa closely following the last minute. This is the sixth extension for debate, in the last the script has been the same and at the moment there are no indications that it will be different.

Social agents, especially employers, are not directly opposed to the idea, but question the details. Most of the cost of these training will be borne by the public treasury, but companies will have to co-pay a part and there are reluctance there. The dates for imparting the training or the consequences of not complying with the commitments are other fringes that have not yet been closed and for which the social agents are pressing to postpone the entry into force of the new scheme. As they have raised in the meeting this Thursday to the Government, the aid scheme should be extended as it is until November and from then on the training programs come into force and the aid coverage will be extended until January 31, 2022 .

In turns with the ‘counter to zero’

Another folder pending closure in the negotiation of the new extension of the ERTE are the conditions for the workers. Currently the so-called ‘counter to zero’, that is, all workers in ERTE, regardless of whether they have accumulated enough contributions or not, have the right to collect unemployment, runs until January 1. The unions ask that coverage be extended until June 2022. That is, if a worker in ERTE loses his job in the coming months, until June 2022 his unemployment benefit is assured. At the moment there is no agreement on this issue, but from the Ministry of Labor they reiterate their intention to study the proposal and negotiate an extension of that ‘counter to zero’.
