Andrew presented Giuffre’s settlement with Epstein as part of his attempt to dismiss his case, arguing that it protects him. The prince’s lawyers maintain that the agreement contains provisions that prohibit Giuffre from taking legal action against many of Epstein’s associates.

The open agreement establishes that upon receiving the stipulated sum, Giuffre, referred to by his maiden name, undertakes to “compensate, release, absolve, satisfy and dismiss said seconds forever and any other person or entity that could have been listed as a potential defendant … of any and all actions and actions of Virginia Roberts, including state or federal causes and causes of action. “

Andrew is not mentioned in the published agreement. Neither is attorney Alan Dershowitz, whom Giuffre has accused of Epstein-facilitated sexual misconduct, which he has repeatedly denied.

In a court docket on October 29, Andrew’s attorneys said: “Giuffre settled his sex trafficking and sexual abuse claims against Epstein in 2009. By doing so, he provided Epstein with a blanket release of all claims against him and many others. people and entities.

The lawyers also said: “Because Prince Andrew is a high-ranking member of the British royal family, he falls into one of the expressly identified categories of persons, namely royalty, released from liability under the release agreement. , along with politicians, academics and businessmen and others supposedly associated with Epstein.

“As a third party beneficiary of the release agreement, Prince Andrew has the right to enforce the general release contained therein.”

Prince Andrew’s lawyers also said Dershowitz was protected by the deal. Giuffre filed a defamation lawsuit against the attorney on April 16, 2019. Dershowitz filed Epstein’s settlement agreement in his fight against that lawsuit.

“Professor Dershowitz, as a third-party beneficiary of the 2009 settlement agreement, had the right to trust and enforce the terms of that secret agreement,” Prince Andrew’s lawyers said.

On December 14, in explaining why the settlement should be presented publicly, justices in the Prince Andrew and Dershowitz cases said: “Mr. Epstein, as is well known, has passed away. Ms. Giuffre is well aware of the document and, although it is sealed, it has been available to all parties in these cases for some time.

“We wonder if the continued secrecy of the document would serve any purpose, except perhaps the dollar amount of the agreement it stipulated.”

On December 29, the judges ordered the deal to be opened, saying that no one, including representatives of the Epstein estate, had adequately demonstrated why it should remain a secret.

Maxwell, 60, says he is innocent. His lawyers said they planned to appeal.
