The Government limits the system of access to public teaching to interns

Interims with more than seven years will not have to take an exam to get a place, but those who have been since 2016 will, although it will be easier


The Council of Ministers has approved this Tuesday, April 12, at the proposal of the Ministry of Education and Vocational Training, the Royal Decree that modifies the system of access to the teaching public function for the years 2022, 2023 and 2024, with the aim of reducing temporality in the public education sector and thus apply Law 20/2021, of December 28, on urgent measures to reduce temporary employment in public employment, the so-called ‘Interim Law’.

According to the approved text, this new access system will only be applicable to long- and medium-term temporary staff.

As the Government spokesperson, Isabel Rodríguez, has stated, there are more than 550,000 teachers in the Spanish public system, both teachers and professors, of which 23% are in an interim situation. “What it is about is putting an end to these circumstances in order to meet the objective of 8% temporary employment in this area in 3 years,” she pointed out.

In this way, the Royal Decree establishes two different processes for interims, and another for new applicants: an extraordinary procedure of merits for long-term interims; an ordinary competition-opposition procedure for those of medium duration; and another ordinary one, also competitive, but with the current system, for new applicants and new interims.

Thus, interims who have been working in the public teaching system since before January 1, 2016 will not have to complete the opposition phase to obtain a place. The procedure for access to the public function of these temporary workers will be through an extraordinary merit contest. The places to be convened will only be for stabilization and the autonomous communities may convene this procedure only once until 2024.

Secondly, an entry system is established by ordinary competitive examination, which is aimed at positions occupied by temporary personnel in the three years prior to December 31, 2020, to which are added the positions of the stabilization processes of the General State Budget laws for 2017 and 2018.

This access system is new: the opposition phase will consist of the development of a theme and the exposition of a didactic unit, thus eliminating the practical test and the delivery of the didactic programming, as is done until now. In addition, the phases of the opposition will not be eliminatory, and the scale of merits changes with respect to the current system, valuing more work experience.

Finally, those interims who have been in office since 2021 and the new applicants will be governed by the current competition-opposition system. For these, the places called will be replacement and newly created.
