The governing board of Torrevieja Town Hall has decided not to award the contract for waste collection services, transportation to landfill, street cleaning and maintenance of the coast with four reports against: three from the director of Legal Services – nationally licensed – and one from the supervising engineer of the service. In turn, there is one in favor of not awarding the general director of Contracting, while the general director of Urban Planning has also spoken favorably, with three reports – both trusted officials appointed by the mayor Eduardo Dolon-.
The governing board met yesterday, shortly before the beginning of the regular plenary session this month, to approve this proposed report signed by the general director of Contracting, Rosana Narejos, in which it stated that the two options – award or not, were valid but finally, it considered that in the public interest the decision not to award “avoids a scenario of non-compliance with the Stability and Sustainability law”, and allows to rethink the way of managing the service and the substantial reduction of the tender price, without sacrificing quality – says the agreement – and a more efficient management from the economic point of view ». This report was not validated on Wednesday with its signature by the mayor of Urban Cleaning and Contracting, Carmen Gómez, responsible for the file. Gomez did attend to finally ratify it at the governing board yesterday.
The process by which this award is annulled, which contemplated a disbursement of 466 million euros over 15 years -25 million euros per year -, began after the warning of the controller that the expected income for 2021 could put in between said the sustainability of this provision.
Torrevieja has paid 65 million euros without a contract to Acciona, the company that currently performs the service, for providing the service since June 2016 without a contract. His ten-year grant and two-year extension ended at that time. With the decision adopted yesterday, the company will maintain the provision irregularly until the municipality starts a new file -the fourth for the same objective since 2015-, and decides on the management model. In 2016 municipalization was ruled out.
In 2019, with the change of government, an indirect management contract with the already submitted bonds. The mayor is committed to the creation of a joint venture – the slowest to process. Next, at the same point in the governing board, the five bidders who have participated in the tender are recognized the right to receive “compensation” for the expenses they have incurred for participating in the tender. In total 99,014 euros, 19,802 euros for each company. The contest was presented Valoriza-STV, UTE FCC-OHl, UTE Actúa-3RS, Urbaser and Acciona.
The award process was halted when the engineer supervising the provision assessed the technical offers or B of the tender (A corresponds to the presentation of documentation and C to the presentation of economic offers) . The third report of the legal advisor calls into question the attitude of the general director of Urbanism and Services at that time. He assures that he went to the hiring table, to indicate “that he was going to make a report in which he was going to propose the withdrawal of the contract for the Waste Collection Services” on the basis that the specifications violated the legality, due to lack of clarity, which made assessment impossible. This proposal, says the legal director, was “made when not even four hours had elapsed since the issuance of the bid evaluation report by the municipal technician.”
